On measures to further improve the public procurement system and the widespread involvement of business entities in the public procurement process

A resolution of the President on measures to further improve the public procurement system and the widespread involvement of business entities in the public procurement process was adopted.

In accordance with the resolution, starting from January 1, 2020, some companies and enterprises of strategic importance shall place the announcement on public procurement on a special information portal before making purchases.

The announcement must indicate at least a fifteen-day deadline for the acceptance by the procurement commission of proposals and information provided for in the legislation. Also, on the day the protocol of the procurement commission is drawn up, it is posted on a special public procurement information portal for public discussion for 2 days.

Starting from April 1, 2020, the Treasury execution mechanism is introduced by opening personal accounts in the Treasury of the Ministry of Finance with respect to funds of budgetary organizations in foreign currency.

Moreover, according to the amendments, an updated List of enterprises of strategic importance was approved, for which the another procedure for the procurement of goods (work, services) is established.

Also, now this special procedure will not apply to enterprises where there is a share of strategic buyers in the authorized capital.

In addition, now when purchasing goods (works, services), direct contracts will be drawn up between the state authority and the state customers that is part of such authority’s structure. Until today, this rule has been valid only in relation to the procurement of goods (works, services) between enterprises that are part of the structure of the ministry themselves.

Also, now the purchase of goods (works, services) from legal entities, in which more than 50 percent of employees are persons with disabilities, will be carried out through direct contracts.
