Purpose of this Law<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The purpose of this Law is to regulate relations in the field of privatization of non-agricultural land plots.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 2. Legislation on the privatization of non-agricultural land plots<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Legislation on the privatization of non-agricultural land plots consists of this Law and other legislative acts.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">If an international treaty of the Republic of Uzbekistan establishes other rules than those provided for by the legislation of the Republic of Uzbekistan on the privatization of land plots for non-agricultural purposes, then the rules of the international treaty are applied.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 3. General definitions<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The following general definitions <\/span><span style=\"font-size: 11pt;\">are applied<\/span><span style=\"font-size: 11pt;\"> in this Law:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">free land plot \u2013 a non-agricultural land plot, which is in state ownership, on which buildings and structures are not located, not burdened with any obligations or prohibitions and not allocated to individuals and legal entities in accordance with the law;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">state-owned<\/span><span style=\"font-size: 11pt;\"> real estate objects \u2013 property complexes (enterprises), buildings and structures, construction-in-progress objects that are in state ownership;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">privatization<\/span><span style=\"font-size: 11pt;\"> of a land plot \u2013 the alienation of a non-agricultural land plot, which is in state ownership, into the ownership of citizens and (or) legal entities of the Republic of Uzbekistan;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">electronic online auction \u2013 a method of conducting electronic trading in the form of an auction, in which non-agricultural land plots are sold on a specialized electronic trading platform on the Internet on the basis of equal access to the auction of potential buyers;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">non-agricultural<\/span><span style=\"font-size: 11pt;\"> land plot (hereinafter referred to as the land plot) \u2013 a land plot not provided for the needs of agriculture or not intended for these purposes.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 4. Fundamental principles of land privatization<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Fundamental principles of land privatization are:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">legality<\/span><span style=\"font-size: 11pt;\">;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">voluntariness<\/span><span style=\"font-size: 11pt;\">;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">compensation<\/span><span style=\"font-size: 11pt;\">;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">integrity<\/span><span style=\"font-size: 11pt;\"> of privatized land plots and real estate objects located on them;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">openness<\/span><span style=\"font-size: 11pt;\"> and transparency.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 5. The principle of legality<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Privatization of land plots <\/span><span style=\"font-size: 11pt;\">must be carried out<\/span><span style=\"font-size: 11pt;\"> strictly in accordance with the requirements of this Law and other legislative acts.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 6. The principle of voluntariness<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Privatization of land plots <\/span><span style=\"font-size: 11pt;\">is carried out<\/span><span style=\"font-size: 11pt;\"> on a voluntary basis.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Citizens and legal entities of the Republic of Uzbekistan exercise their rights to privatize land plots at their own discretion and in their own interests.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Coercion to privatize land plots <\/span><span style=\"font-size: 11pt;\">is prohibited<\/span><span style=\"font-size: 11pt;\">.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Article 7. The principle of compensation<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Privatization of land plots <\/span><span style=\"font-size: 11pt;\">is carried out<\/span><span style=\"font-size: 11pt;\"> on a paid basis.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 8. The principle of integrity of privatized land plots and real estate objects located on them<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Privatization of land plots and state-owned real estate objects located on them <\/span><span style=\"font-size: 11pt;\">is carried out<\/span><span style=\"font-size: 11pt;\"> simultaneously.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 9. The principle of openness and transparency.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The process of land privatization should be open and transparent.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">State bodies and organizations are obliged to provide free access to information on the privatization of land plots in the ways established by the legislation on the openness of the activities of state authorities and administration.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 10. Privatization objects<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Privatization objects are:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">land<\/span><span style=\"font-size: 11pt;\"> plots provided to legal entities for the implementation of entrepreneurial and urban planning activities;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">land<\/span><span style=\"font-size: 11pt;\"> plots provided to citizens of the Republic of Uzbekistan for individual housing construction and maintenance of a residential building, as well as the implementation of entrepreneurial and urban planning activities;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">land<\/span><span style=\"font-size: 11pt;\"> plots on which state real estate objects subject to privatization are located;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">free<\/span><span style=\"font-size: 11pt;\"> land plots.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 11. Urban planning requirements for the privatization of land plots<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Privatization of land plots is carried out in accordance with the general plans of settlements, detailed planning projects for parts of settlements or other documents on the integrated development and planning of territories or types of permitted use of land plots, except for the cases provided for in part two of this article.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Land plots held by subjects of privatization on the right of permanent use (possession), lease or lifetime inheritable possession that arose before the entry into force of this Law, as well as land plots on which state-owned real estate objects subject to privatization are located, may be privatized before approval of town planning documents provided for by part one of this article, subject to the preservation of the main intended purpose of these land plots.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 12. Land plots not subject to privatization<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Following land plots are not subject to privatization:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">where<\/span><span style=\"font-size: 11pt;\"> mineral deposits are located, state-owned objects that are not subject to privatization in accordance with the law;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">included in the lands of nature conservation, recreational, historical and cultural purposes, as well as lands of forest and water funds, protective zones of engineering and transport infrastructure facilities, general use of cities and towns (squares, streets, driveways, roads, embankments, squares, boulevards , parks);<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">contaminated<\/span><span style=\"font-size: 11pt;\"> with hazardous substances and susceptible to biogenic contamination;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">provided<\/span><span style=\"font-size: 11pt;\"> in the manner prescribed by law to participants in special economic zones \u2013 for the period of operation of the special economic zone;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">on<\/span><span style=\"font-size: 11pt;\"> which apartment buildings are located, as well as land plots adjacent to apartment buildings;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">provided<\/span><span style=\"font-size: 11pt;\"> for the implementation of public-private partnership projects, agreements and agreements on social partnership, as well as legal entities for state and public needs.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">When privatizing land plots, the right to limited use of another&#8217;s land plot (servitude) <\/span><span style=\"font-size: 11pt;\">may be established<\/span><span style=\"font-size: 11pt;\"> in the manner prescribed by civil law.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 13. Subjects of privatization<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The subjects of privatization are citizens and legal entities of the Republic of Uzbekistan.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Foreign citizens, stateless persons, foreign legal entities, enterprises with foreign investments, as well as state bodies, institutions and enterprises are not subject to privatization.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 14. Forms of land privatization<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Privatization of land plots <\/span><span style=\"font-size: 11pt;\">is carried out<\/span><span style=\"font-size: 11pt;\"> in the following forms:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">redemption<\/span><span style=\"font-size: 11pt;\"> by subjects of privatization of land plots that they have on the right of permanent use (possession), lease or lifetime inheritable possession;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">purchase<\/span><span style=\"font-size: 11pt;\"> of land plots through an electronic online auction.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 15. Direction of funds received from the privatization of land plots<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The funds received from the privatization of land plots, net of expenses, the list and amounts of which <\/span><span style=\"font-size: 11pt;\">are established<\/span><span style=\"font-size: 11pt;\"> by the Cabinet of Ministers of the Republic of Uzbekistan, are sent to the State Budget of the Republic of Uzbekistan.<\/span><\/p>\n<p style=\"text-align: center; margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><strong><span style=\"color: #2e74b5; font-size: 11pt;\">CHAPTER 2. STATE ADMINISTRATION IN THE FIELD OF LAND PRIVATIZATION<\/span><\/strong><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 16. The procedure for filing and considering an application for the privatization of land plots<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">An application for the privatization of land plots (hereinafter referred to as the application) <\/span><span style=\"font-size: 11pt;\">is submitted<\/span><span style=\"font-size: 11pt;\">:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">by a legal entity of the Republic of Uzbekistan \u2013 in relation to land plots provided to it for entrepreneurial and urban planning activities and which are on the right of permanent use (possession) or lease;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">a<\/span><span style=\"font-size: 11pt;\"> citizen of the Republic of Uzbekistan \u2013 in relation to land plots provided to him for individual housing construction and maintenance of a residential building, as well as for the implementation of entrepreneurial and urban planning activities and which he has on the right of lifetime inheritable possession, permanent use or lease.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Upon transfer to legal entities and individuals of the Republic of Uzbekistan, respectively, the right to permanent use (possession), lifetime inheritable possession or lease of a land plot, the right to privatize this land plot also passes to them.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">If the land plot <\/span><span style=\"font-size: 11pt;\">is jointly owned or used by several subjects of privatization,<\/span><span style=\"font-size: 11pt;\"> the application is submitted by agreement of all subjects, concluded in accordance with civil law, if such consent is not reached, in the manner established by the court.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The application <\/span><span style=\"font-size: 11pt;\">is submitted<\/span><span style=\"font-size: 11pt;\"> through the centers of public services or the Unified portal of interactive public services of the Republic of Uzbekistan.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The <\/span><span style=\"font-size: 11pt;\">list of documents attached to the application is determined by the Cabinet of Ministers of the Republic of Uzbekistan<\/span><span style=\"font-size: 11pt;\">.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Consideration of the application <\/span><span style=\"font-size: 11pt;\">is carried<\/span><span style=\"font-size: 11pt;\"> out using an automated information system in accordance with the Administrative Regulations for the provision of public services for the privatization of land plots.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The result of consideration of the application is a notification, which may contain a positive or negative decision.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">A notice with a positive decision is the basis for the applicant to pay the redemption value of the privatized land plot.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The notice with a negative decision indicates the justified reasons for the impossibility of privatizing the land plot with reference to the specific requirements of urban planning documents or legislative norms.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The results of consideration of the application <\/span><span style=\"font-size: 11pt;\">may be appealed<\/span><span style=\"font-size: 11pt;\"> in court.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 22. Determination of the area and boundaries of the privatized land plot<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Privatization of land plots held by the subjects of privatization on the right of permanent use (possession), lease or lifetime inheritable possession is carried out within the area and boundaries specified in the State Register of rights to real estate. Grounds for refusal to privatize land plots<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The grounds for refusal to privatize land plots are:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">lack<\/span><span style=\"font-size: 11pt;\"> of grounds for the privatization of land plots provided for in this Law;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">presence<\/span><span style=\"font-size: 11pt;\"> of pending legal proceedings in respect of privatized land plots;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">the<\/span><span style=\"font-size: 11pt;\"> presence of a ban or arrest imposed on real estate objects located on privatized land plots;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">the presence in the approved master plans of settlements, projects of detailed planning of parts of a settlement, other documents on the integrated development and development of territories or types of permitted use of a land plot of information that directly prevents the privatization of land plots;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">availability<\/span><span style=\"font-size: 11pt;\"> of decisions of the Jokargy Kenes of the Republic of Karakalpakstan, Kengashes of people\u2019s deputies of the regions and the city of Tashkent or decisions of the Cabinet of Ministers of the Republic of Uzbekistan on the withdrawal of land plots for state and public needs, taken before the application was submitted;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">the<\/span><span style=\"font-size: 11pt;\"> presence of a ban on the sale or other alienation of the privatized land plot;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">detection<\/span><span style=\"font-size: 11pt;\"> of false, contradictory or distorted information in the application;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">non-fulfillment<\/span><span style=\"font-size: 11pt;\"> or incomplete fulfillment of payment of the redemption value of the land plot to be privatized within the period established by this Law.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Refusal to privatize land plots on other grounds <\/span><span style=\"font-size: 11pt;\">is not allowed<\/span><span style=\"font-size: 11pt;\">.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">In the event that the reasons that served as the basis for the refusal to privatize land plots <\/span><span style=\"font-size: 11pt;\">are eliminated<\/span><span style=\"font-size: 11pt;\">, the applicant has the right to re-submit an application without paying a fee for the provision of public services within one month from the date of receipt of the refusal.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 24. Determination and payment of the redemption value of the privatized land plot<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The redemption value of a privatized land plot, located at the subject of privatization on the right of permanent use (possession), lease or lifetime inheritable possession, is established by the Cabinet of Ministers of the Republic of Uzbekistan in multiples of the base rate of land tax from legal entities and individuals established for the relevant lands at the time of privatization.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">When determining the amount of the redemption value of a privatized land plot, the Cabinet of Ministers of the Republic of Uzbekistan has the right to establish differentiated <\/span><span style=\"font-size: 11pt;\">coefficients for certain<\/span><span style=\"font-size: 11pt;\"> categories of land plots, as well as subjects of privatization, including persons exempted from paying land tax.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Payment of the redemption value of the land plot to be privatized is carried out by the applicant<\/span><span style=\"font-size: 11pt;\"> within ten working days after receiving a notice with a positive decision.<\/span><\/p>\n<p style=\"text-align: center; margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><strong><span style=\"color: #2e74b5; font-size: 11pt;\">CHAPTER 4. PRIVATIZATION OF LND PLOTS THROUGH AN ELECTRONIC ONLINE AUCTION<\/span><\/strong><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 25. Privatization of free land plots<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Free land plots are determined in accordance with the general plans of settlements, projects of detailed planning of parts of settlements, other documents on the integrated development and development of territories, types of permitted use of land plots.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Free land plots <\/span><span style=\"font-size: 11pt;\">are privatized<\/span><span style=\"font-size: 11pt;\"> through an electronic online auction.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 26. Privatization of land plots on which state-owned real estate objects are located<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Land plots on which state real estate objects subject to privatization are located <\/span><span style=\"font-size: 11pt;\">are determined<\/span><span style=\"font-size: 11pt;\"> by the State Assets Management Agency of the Republic of Uzbekistan in accordance with approved privatization programs.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Land plots on which state-owned real estate objects subject to privatization are located are put up for an electronic online auction as a single property complex.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 27. The cost of the privatized land<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The cost of a privatized land plot is determined based on the results of an electronic online auction.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The starting price of a land plot put up for an electronic online auction is set based on its market value at the time it is put up for an electronic online auction.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The starting price of a land plot on which state-owned real estate objects subject to privatization are located is set based on the value of this object as a single property complex.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The size of the deposit and the price of the step are set as a percentage of the starting price and in monetary terms.<\/span><\/p>\n<p style=\"text-align: center; margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><strong><span style=\"color: #2e74b5; font-size: 11pt;\">CHAPTER 5. LEGAL STATUS OF PRIVATIZED LAND PLOTS<\/span><\/strong><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 29. State warrant for the ownership of a land plot<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The state warrant for the ownership of a land plot is a title document and <\/span><span style=\"font-size: 11pt;\">is issued<\/span><span style=\"font-size: 11pt;\"> by the State Assets Management Agency of the Republic of Uzbekistan within one working day after the full and timely payment of the cost of the privatized land plot is made.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">In case of privatization of a land plot simultaneously with a state-owned real estate object located on it, a single state order <\/span><span style=\"font-size: 11pt;\">is issued<\/span><span style=\"font-size: 11pt;\"> for the ownership of the land plot and the real estate object.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">No state fee <\/span><span style=\"font-size: 11pt;\">is charged<\/span><span style=\"font-size: 11pt;\"> for the issuance of state warrants.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 30. The right of private ownership of a privatized land plot<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Privatized land plots are private property and objects of civil circulation.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The right of private ownership of a privatized land plot arises from the moment of state registration of the right to it by entering the relevant information in the State Register of Rights to Real Estate in electronic form.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The right of private ownership of privatized land plots is inviolable and protected by the state in accordance with the law.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 31. Rights of owners of privatized land plots<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Owners of privatized land plots have the right to:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">freely own, use and dispose of a privatized land plot at one\u2019s own discretion and in one\u2019s own interests, including using it as a pledge, making a contribution to the authorized capital (authorized fund) of a legal entity, leasing it without violating the rights and protected by law the interests of legal entities and individuals, the state;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">demand<\/span><span style=\"font-size: 11pt;\"> the elimination of any violations of the ownership of the privatized land plot;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">manage<\/span><span style=\"font-size: 11pt;\"> independently on a privatized land plot;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">erect<\/span><span style=\"font-size: 11pt;\"> residential, industrial, cultural and other buildings and structures, carry out their restructuring and demolition.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 32. Obligations of owners of privatized land plots<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Owners of privatized land plots are obliged to:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">comply<\/span><span style=\"font-size: 11pt;\"> with the requirements of regulatory documents in the field of technical regulation when using the land plot;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">to<\/span><span style=\"font-size: 11pt;\"> compensate in accordance with the established procedure the damage caused to other owners of land plots.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 33. Emergence of ownership of land plots by persons who are not subjects of privatization<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Foreign citizens, stateless persons, foreign legal entities, enterprises with foreign investments do not have the right to acquire privatized land plots, unless otherwise provided by law.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">In the event that a foreign citizen, a stateless person, a foreign legal entity, an enterprise with foreign investment has the right to own land plots, these land plots are subject to alienation within six months from the date of such an event.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">If the land plots <\/span><span style=\"font-size: 11pt;\">are not alienated<\/span><span style=\"font-size: 11pt;\"> within the period provided for by part two of this article, the land plots shall become the property of the state, with the persons indicated by this article retaining the pre-emptive right to acquire them on lease in the manner prescribed by law.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 34. Withdrawal of the privatized land plot from the owner<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Withdrawal of a privatized land plot from the owner <\/span><span style=\"font-size: 11pt;\">is allowed<\/span><span style=\"font-size: 11pt;\"> only in the following cases:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">foreclosure<\/span><span style=\"font-size: 11pt;\"> on a land plot according to executive documents;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">redemption<\/span><span style=\"font-size: 11pt;\"> of a land plot for state and public needs;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">land<\/span><span style=\"font-size: 11pt;\"> confiscation;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">land<\/span><span style=\"font-size: 11pt;\"> requisition.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 35. Determining the value of a privatized land plot subject to foreclosure<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The cost of a privatized land plot in the event of foreclosure on this land plot for the obligations of the owner is determined in accordance with the law.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The cost of the withdrawn privatized land plot, determined by the appraisal organization, <\/span><span style=\"font-size: 11pt;\">may be challenged<\/span><span style=\"font-size: 11pt;\"> in court.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 36. Redemption of a privatized land plot for state and public needs<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Redemption of a privatized land plot for state and public needs:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">carried<\/span><span style=\"font-size: 11pt;\"> out only upon receipt of the written consent of the owner of the land;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">drawn up by a contract for the sale of a land plot, concluded on equal terms between the owner of the land plot and, accordingly, on behalf of the Council of Ministers of the Republic of Karakalpakstan, khokims of regions and the city of Tashkent;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">is<\/span><span style=\"font-size: 11pt;\"> carried out subject to advance payment by the state of the contractual cost of the land.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The redemption of a privatized land plot for state and public needs <\/span><span style=\"font-size: 11pt;\">is allowed<\/span><span style=\"font-size: 11pt;\"> only for the following purposes:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">provision<\/span><span style=\"font-size: 11pt;\"> of land for the needs of defense and state security, protected natural areas, creation and operation of special economic zones;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">fulfillment<\/span><span style=\"font-size: 11pt;\"> of obligations arising from international treaties of the Republic of Uzbekistan;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">discovery<\/span><span style=\"font-size: 11pt;\"> and development of mineral deposits;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">construction (reconstruction) of highways and railways, airports, airfields, air navigation facilities and aviation technical centers, railway transport facilities, bridges, subways, tunnels, energy systems and power transmission lines, communication lines, space facilities, trunk pipelines, engineering and communication networks;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">execution<\/span><span style=\"font-size: 11pt;\"> of master plans of settlements in terms of the construction of facilities at the expense of the State budget of the Republic of Uzbekistan, as well as in other cases directly provided for by laws of the Republic of Uzbekistan and decisions of the President of the Republic of Uzbekistan.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The redemption of privatized land plots for state and public needs is carried out only after an open discussion with the owners of the land plots of the price of the contract and the terms of the redemption, as well as after the mandatory agreement with the relevant Centralized Fund for indemnification of individuals and legal entities in connection with the withdrawal of land plots from them for state and public needs.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Payment of the redemption value of the privatized land plot <\/span><span style=\"font-size: 11pt;\">is made<\/span><span style=\"font-size: 11pt;\"> in full until the transfer of ownership of the land plot to the state.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Disagreements between the Council of Ministers of the Republic of Karakalpakstan, the khokims of the regions and the city of Tashkent and the owner of a privatized land plot on the conclusion of a land plot sale and purchase agreement are subject to resolution in court.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 37. Requisition of a privatized land plot<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">In cases of natural disasters, accidents, epidemics, epizootics and under other circumstances of an emergency nature, by decision of the Cabinet of Ministers of the Republic of Uzbekistan, a privatized land plot <\/span><span style=\"font-size: 11pt;\">can be withdrawn<\/span><span style=\"font-size: 11pt;\"> from its owner (requisition) with compensation to the owner of the privatized land plot for the losses caused and issuance of a document on requisitions.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The requisition of a privatized land plot <\/span><span style=\"font-size: 11pt;\">is carried out<\/span><span style=\"font-size: 11pt;\"> solely in order to protect the rights and legitimate interests of citizens of the Republic of Uzbekistan, society and the state from threats arising in connection with emergency circumstances.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Upon termination of the circumstances in connection with which the requisition <\/span><span style=\"font-size: 11pt;\">was made<\/span><span style=\"font-size: 11pt;\">, the former owner of the requisitioned land plot has the right to demand the return of the remaining property to him\/her.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">If it is impossible to return the requisitioned land plot to its owner, the market value of this land plot <\/span><span style=\"font-size: 11pt;\">is reimbursed<\/span><span style=\"font-size: 11pt;\"> or, at his\/her request, another equivalent land plot is provided for ownership.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">In the event of the occurrence of the circumstances specified in part one of this article, in the absence of the need to requisition a land plot, it may be temporarily, for the period of these circumstances, occupied for use with compensation to the owner of the land plot for losses caused in connection with the temporary restriction of his rights.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">An appraisal according to which the market value of the requisitioned land plot is reimbursed to the owner of the land plot, losses caused in connection with its requisition or temporary restriction of the rights of the owner of the land plot, may be challenged by him\/her<\/span><span style=\"font-size: 11pt;\"> in court.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 38. Confiscation of a privatized land plot<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">In cases stipulated by the criminal procedural legislation, a privatized land plot <\/span><span style=\"font-size: 11pt;\">may be withdrawn<\/span><span style=\"font-size: 11pt;\"> from the owner by a court decision (confiscation).<\/span><\/p>\n<p style=\"text-align: center; margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><strong><span style=\"color: #2e74b5; font-size: 11pt;\">CHAPTER 6. FINAL PROVISIONS<\/span><\/strong><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 39. Resolution of Disputes<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Disputes arising in the field of privatization of land plots are resolved in the manner prescribed by law.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 40. Responsibility for violation of legislation on privatization of non-agricultural land plots<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Persons guilty of violating the legislation on the privatization of non-agricultural land plots are liable in the prescribed manner.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 41. Recognition as invalid of some legislative acts of the Republic of Uzbekistan<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Recognize as invalid the following legislative documents:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">1) Law No. LRU-552 of the Republic of Uzbekistan \u201cOn the privatization of land plots for non-agricultural purposes\u201d dated August 13, 2019 (Bulletin of the chambers of the Oliy Majlis of the Republic of Uzbekistan, 2019, No. 8, Art. No. 463);<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">2) Article 272 of the Law No. LRU-683 of the Republic of Uzbekistan \u201cOn amendments and additions to certain legislative acts of the Republic of Uzbekistan\u201d dated April 21, 2021 (Bulletin of the Oliy Majlis of the Republic of Uzbekistan, 2021, Appendix No. 4);<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">3) Article 14 of the Law No. <\/span><span style=\"font-size: 11pt;\">LRU-708 of the Republic of Uzbekistan On amendments and additions to some legislative acts of the Republic of Uzbekistan in connection with improving the procedure for providing land plots and their use, as well as the system of land registration and maintaining the state land cadastre \u201d dated August 16, 2021 (Bulletin of the chambers of the Oliy Majlis of the Republic of Uzbekistan, 2021, No. 8, Art.<\/span><span style=\"font-size: 11pt;\"> No. 800).<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 42. Ensuring the execution, communication, clarification of the essence and meaning of this Law<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">The Ministry of Economic Development and Poverty Reduction of the Republic of Uzbekistan and other interested organizations shall ensure the implementation, communication to the executors and clarification among the population of the essence and significance of this Law.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 43. Bringing legislation in line with this Law<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Cabinet of Ministers of the Republic of Uzbekistan should:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">bring<\/span><span style=\"font-size: 11pt;\"> government decisions in line with this Law;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">ensure<\/span><span style=\"font-size: 11pt;\"> the revision and cancellation by the state administration bodies of their normative legal acts that are contrary to this Law.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">Article 44.
