ON APPROVAL OF THE REGULATION ON THE PROCEDURE FOR MONITORING THE PROCESS OF IMPLEMENTATION OF INVESTMENT PROJECTS IMPLEMENTED ON THE BASIS OF PREVIOUSLY PRIVATIZED UNFINISHED CONSTRUCTION OBJECTS AND UNUSED PRODUCTION FACILITIES<\/span><\/strong><\/p>\n

In pursuance of the Resolution of the President of the Republic of Uzbekistan dated April 18, 2017 \u2116. RP-2897 \u201cOn measures to organize the activities of the State Committee of the Republic of Uzbekistan to promote privatized enterprises and the development of competition\u201d and to improve the monitoring of the implementation of investment projects carried out on the basis of previously privatized unfinished the construction of facilities and unused production facilities, the Cabinet of Ministers decides:<\/span><\/strong><\/p>\n

1. To approve the Regulations on the procedure for monitoring the process of implementation of investment projects implemented <\/span>on the basis of<\/span> previously privatized unfinished construction objects and unused production facilities, according to the appendix.<\/span><\/strong><\/p>\n

2. The control over the implementation of this resolution <\/span>shall be assigned<\/span> to the Deputy Prime Minister of the Republic of Uzbekistan D. A. <\/span>Kuchkarov<\/span>.<\/span><\/strong><\/p>\n

REGULATION<\/span><\/strong><\/p>\n

on the procedure for monitoring the process of implementation of investment projects implemented on the basis of previously privatized unfinished construction objects and unused production facilities<\/span><\/strong><\/p>\n

.<\/span><\/span><\/p>\n

CHAPTER 1. GENERAL PROVISIONS<\/span><\/strong><\/p>\n

1. This Regulation determines the monitoring procedure for the implementation of investment projects carried out <\/span>on the basis of<\/span> previously privatized construction and unused production facilities.<\/span><\/p>\n

The requirements of this Regulation do not apply to facilities provided to legal entities and individuals in connection with the seizure of their land for state and public needs.<\/span><\/p>\n

2. The following basic concepts apply in these Regulations:<\/span><\/p>\n

interdepartmental<\/span> commission<\/span><\/strong> \u2014 interdepartmental commissions for inventory and identification of construction in progress and unused production facilities, created in accordance with the resolution of the President of the Republic of Uzbekistan dated February 23, 2017 No. RP-2796 \u201cOn measures to further stimulate the use of production facilities by entrepreneurs\u201d;<\/span><\/p>\n

working<\/span> body<\/span><\/strong> \u2014 the territorial bodies of the State Committee of the Republic of Uzbekistan to promote privatized enterprises and the development of competition;<\/span><\/p>\n

previously privatized objects \u2014 buildings, non-residential premises and unfinished construction of real estate objects transferred by the state to private ownership (including transfer to the authorized capital, sale and disposal by other means), regardless of the subsequent change of ownership;<\/span><\/p>\n

unused production facilities \u2014 previously privatized buildings and non-residential premises, more than 50 percent of the total area of which (within the contour of one building or non-residential premises) has not been involved in the production of goods (work, services) over the past 12 months;<\/span><\/p>\n

incomplete construction projects \u2014 previously privatized real estate objects whose construction was not completed within the regulatory period established by the design and estimate documentation, and in the absence of a specified regulatory construction period \u2014 within 24 months from the start of construction;<\/span><\/p>\n

project<\/span> initiators<\/span><\/strong> \u2014 owners of previously privatized facilities, implementing investment projects on the basis of privatized facilities under construction and unused production facilities;<\/span><\/p>\n

investment projects<\/span><\/strong> \u2014 projects for the organization of the production of products or facilities in the service sector with investments and job creation, implemented on the basis of privatized construction in progress and unused production facilities, approved by the interdepartmental commission;<\/span><\/p>\n

responsible<\/span> organizations<\/span><\/strong> \u2014 organizations involved in monitoring the implementation of investment projects and providing information to the working body in accordance with this Regulation.<\/span><\/p>\n

CHAPTER 2. THE PROCEDURE FOR MONITORING THE IMPLEMENTATION OF INVESTMENT PROJECTS<\/span><\/strong><\/p>\n

3. The working body monitors the implementation of investment projects developed and approved by interdepartmental commissions and commercial banks, together with project initiators in accordance with the decree of the President of the Republic of Uzbekistan dated February 23, 2017 <\/span>No<\/span>. RP-2796 \u201cOn measures <\/span>to further stimulate<\/span> the use of production facilities by entrepreneurs\u201d.<\/span><\/p>\n

4. <\/span>In<\/span> the framework of monitoring the implementation of investment projects, the working body:<\/span><\/p>\n

keeps<\/span> track of ongoing investment projects with the parameters of investment projects;<\/span><\/p>\n

analyzes<\/span> and summarizes the information provided by project initiators and responsible organizations on the implementation of investment projects;<\/span><\/p>\n

contributes<\/span> information to the interdepartmental commission on the results of monitoring the progress of the implementation of investment projects;<\/span><\/p>\n

coordinates<\/span> the activities of state bodies on issues of promoting privatized enterprises.<\/span><\/p>\n

5. To monitor the progress of the implementation of investment projects, project initiators and responsible organizations monthly, no later than the third day of the month following the reporting month, submit the following information to the working body:<\/span><\/p>\n

project<\/span> initiators<\/span><\/strong> \u2014 information on financing and progress on the implementation of investment projects, including the stipulated financial and economic parameters for the investment project at the date of submission of information, in accordance with <\/span>Appendix No. 1<\/a> to these Regulations;<\/span><\/p>\n

commercial<\/span> banks<\/span><\/strong> \u2014 information on the financing (allocation of loans) of investment projects in accordance with <\/span>Appendix No. 2 <\/a>to these Regulations;<\/span><\/p>\n

state<\/span> tax departments of the Republic of <\/span>Karakalpakstan<\/span>, regions and the city of Tashkent \u2014 information on the implementation of the financial and economic activities of project initiators in accordance with <\/span>Appendix No. 3<\/a> to these Regulations.<\/span><\/p>\n

6. Upon completion of the implementation of the investment project, the project initiator provides information to the working body on the complete implementation of investment projects indicating the fulfillment of project forecast parameters for the volume of investments, production (work, services), exports (if any) and the number of new jobs.<\/span><\/p>\n

7. After completion of the investment project, the responsible organizations provide the following information to the working body:<\/span><\/p>\n

khokimiyats<\/span> of districts (cities) within three days \u2014 information about the decision of the <\/span>hokim<\/span> of the district (city) on approval of the acceptance certificate for the completed building;<\/span><\/p>\n

the Ministry of Employment and Labor Relations of the Republic of <\/span>Karakalpakstan<\/span>, the Main Employment Departments of the regions and the city of Tashkent together with the state tax <\/span>administrations of the Republic of <\/span>Karakalpakstan<\/span>, regions and the city of Tashkent in a weekly period \u2014 a conclusion on the created jobs during the implementation of the investment project based on the study of the information received, including based on the study of receipt of funds by individual taxpayer numbers (TIN) of individuals from the initiators of investment projects .<\/span><\/p>\n

8. The working body summarizes and analyzes the information received and up to the 7th day of the month following the reporting one, submits to the interdepartmental commission and the State Committee of the Republic of Uzbekistan for the Promotion of Privatized Enterprises and the Development of Competition:<\/span><\/p>\n

a<\/span> certificate of the results of monitoring the implementation of investment projects;<\/span><\/p>\n

summary<\/span> information on the results of monitoring the implementation of investment projects in the form in accordance with <\/span>Appendix No. 4<\/a> to this Regulation;<\/span><\/p>\n

list<\/span> of project initiators who did not implement investment projects.<\/span><\/p>\n

9. The progress of the implementation of investment projects <\/span>is considered<\/span> at meetings of the interagency commission at least once a month.<\/span><\/p>\n

10. The State Committee of the Republic of Uzbekistan for the Promotion of Privatized Enterprises and the Development of Competition summarizes the information received and submits to the Cabinet of Ministers of the Republic of Uzbekistan information on the status of implementation of investment projects and the work of interdepartmental commissions quarterly no later than the 10th day of the month following the reporting quarter.<\/span><\/p>\n
