Qishloq xo\u2018jaligiga mo\u2018ljallanmagan yer uchastkalarini xususiylashtirish to\u2018g\u2018risidagi qonunchilik<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Qishloq xo\u2018jaligiga mo\u2018ljallanmagan yer uchastkalarini xususiylashtirish to\u2018g\u2018risidagi qonunchilik ushbu Qonun <\/span><span style=\"font-size: 11pt;\">va<\/span><span style=\"font-size: 11pt;\"> boshqa qonunchilik hujjatlaridan iboratdir.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Agar O\u2018zbekiston Respublikasining xalqaro shartnomasida O\u2018zbekiston Respublikasining qishloq xo\u2018jaligiga mo\u2018ljallanmagan yer uchastkalarini xususiylashtirish to\u2018g\u2018risidagi qonunchiligida nazarda tutilganidan boshqacha qoidalar belgilangan bo\u2018lsa, xalqaro shartnoma qoidalari qo\u2018llaniladi.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">3-modda. Asosiy tushunchalar<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Ushbu Qonunda quyidagi asosiy tushunchalar qo\u2018llaniladi:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">bo\u2018sh<\/span><span style=\"font-size: 11pt;\"> turgan yer uchastkasi \u2014 binolar va inshootlar joylashmagan, hech qanday majburiyatlar yoki taqiqlar o\u2018rnatilmagan hamda jismoniy va yuridik shaxslarga qonunchilikka muvofiq ajratib berilmagan, davlat mulki bo\u2018lgan, qishloq xo\u2018jaligiga mo\u2018ljallanmagan yer uchastkasi;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">davlat<\/span><span style=\"font-size: 11pt;\"> ko\u2018chmas mulk obyektlari \u2014 davlat mulki bo\u2018lgan mulkiy majmualar (korxonalar), binolar va inshootlar, qurilishi tugallanmagan obyektlar;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">yer<\/span><span style=\"font-size: 11pt;\"> uchastkasini xususiylashtirish \u2014 davlat mulki bo\u2018lgan qishloq xo\u2018jaligiga mo\u2018ljallanmagan yer uchastkasini O\u2018zbekiston Respublikasi fuqarolarining va (yoki) yuridik shaxslarining mulkiga o\u2018tkazish;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">elektron<\/span><span style=\"font-size: 11pt;\"> onlayn-auksion \u2014 auksion shaklidagi elektron savdolarni o\u2018tkazish usuli bo\u2018lib, bunda qishloq xo\u2018jaligiga mo\u2018ljallanmagan yer uchastkalari Internet jahon axborot tarmog\u2018idagi ixtisoslashtirilgan elektron savdo maydonchasida auksiondan potensial xaridorlarning teng ravishda foydalanishi asosida realizatsiya qilinadi;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">qishloq<\/span><span style=\"font-size: 11pt;\"> xo\u2018jaligiga mo\u2018ljallanmagan yer uchastkasi (bundan buyon matnda yer uchastkasi deb yuritiladi) \u2014 qishloq xo\u2018jaligi ehtiyojlari uchun berilmagan yoki ushbu maqsadlar uchun mo\u2018ljallanmagan yer uchastkasi.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">4-modda. Yer uchastkalarini xususiylashtirishning asosiy prinsiplari<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Yer uchastkalarini xususiylashtirishning asosiy prinsiplari quyidagilardan iborat:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">qonuniylik<\/span><span style=\"font-size: 11pt;\">;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">ixtiyoriylik<\/span><span style=\"font-size: 11pt;\">;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">haq<\/span><span style=\"font-size: 11pt;\"> to\u2018lash;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">xususiylashtiriladigan<\/span><span style=\"font-size: 11pt;\"> yer uchastkalarining va ularda joylashgan ko\u2018chmas mulk obyektlarining yaxlitligi;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">ochiqlik<\/span><span style=\"font-size: 11pt;\"> va shaffoflik.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">5-modda. Qonuniylik prinsipi<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Yer uchastkalarini xususiylashtirish ushbu Qonun <\/span><span style=\"font-size: 11pt;\">va<\/span><span style=\"font-size: 11pt;\"> boshqa qonun hujjatlari talablariga qat\u2019iy muvofiq tarzda amalga oshirilishi kerak.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">6-modda. Ixtiyoriylik prinsipi<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Yer uchastkalarini xususiylashtirish ixtiyoriylik asosida amalga oshiriladi.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">O\u2018zbekiston Respublikasining fuqarolari <\/span><span style=\"font-size: 11pt;\">va<\/span><span style=\"font-size: 11pt;\"> yuridik shaxslari yer uchastkalarini xususiylashtirishga bo\u2018lgan o\u2018z huquqlarini o\u2018z ixtiyoriga ko\u2018ra hamda o\u2018z manfaatlaridan kelib chiqqan holda amalga oshiradi.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Yer uchastkalarini xususiylashtirish uchun majburlash taqiqlanadi.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">7-modda. Haq to\u2018lash prinsipi<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Yer uchastkalarini xususiylashtirish pulli asosda amalga oshiriladi.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">8-modda. Xususiylashtiriladigan yer uchastkalarining <\/span><span style=\"font-size: 11pt;\">va<\/span><span style=\"font-size: 11pt;\"> ularda joylashgan ko\u2018chmas mulk obyektlarining yaxlitligi prinsipi<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Yer uchastkalarini <\/span><span style=\"font-size: 11pt;\">va<\/span><span style=\"font-size: 11pt;\"> ularda joylashgan davlat ko\u2018chmas mulk obyektlarini xususiylashtirish bir vaqtning o\u2018zida amalga oshiriladi.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">9-modda. Ochiqlik <\/span><span style=\"color: #2e74b5; font-size: 11pt;\">va<\/span><span style=\"color: #2e74b5; font-size: 11pt;\"> shaffoflik prinsipi<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Yer uchastkalarini xususiylashtirish jarayoni ochiq <\/span><span style=\"font-size: 11pt;\">va<\/span><span style=\"font-size: 11pt;\"> shaffof bo\u2018lishi kerak.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Davlat organlari <\/span><span style=\"font-size: 11pt;\">va<\/span><span style=\"font-size: 11pt;\"> tashkilotlari yer uchastkalarini xususiylashtirish to\u2018g\u2018risidagi axborotdan davlat hokimiyati va boshqaruvi organlari faoliyatining ochiqligi to\u2018g\u2018risidagi qonunchilikda belgilangan usullar orqali erkin foydalanilishini ta\u2019minlashi shart.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">10-modda. Xususiylashtirish obyektlari<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Xususiylashtirish obyektlari quyidagilardan iborat:<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">yuridik<\/span> <span style=\"font-size: 11pt;\">shaxslarga<\/span> <span style=\"font-size: 11pt;\">tadbirkorlik<\/span><span style=\"font-size: 11pt;\">, <\/span><span style=\"font-size: 11pt;\">shaharsozlik<\/span><span style=\"font-size: 11pt;\"> faoliyatini va qonunchilikda taqiqlanmagan boshqa faoliyatni amalga oshirish uchun berilgan yer uchastkalari;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">O\u2018zbekiston<\/span> <span style=\"font-size: 11pt;\">Respublikasi<\/span> <span style=\"font-size: 11pt;\">fuqarolariga<\/span> <span style=\"font-size: 11pt;\">yakka<\/span><span style=\"font-size: 11pt;\"> tartibda uy-joy qurish <\/span><span style=\"font-size: 11pt;\">va<\/span><span style=\"font-size: 11pt;\"> uy-joyni obodonlashtirish, shuningdek tadbirkorlik va shaharsozlik faoliyatini amalga oshirish uchun berilgan yer uchastkalari;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">xususiylashtirilishi<\/span><span style=\"font-size: 11pt;\"> lozim bo\u2018lgan davlat ko\u2018chmas mulk obyektlari joylashgan yer uchastkalari;<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">bo\u2018sh<\/span><span style=\"font-size: 11pt;\"> turgan yer uchastkalari.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">11-modda. Yer uchastkalarini xususiylashtirishga doir shaharsozlik talablari<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Yer uchastkalarini xususiylashtirish aholi punktlarining bosh rejalariga, aholi punktlari qismlarini batafsil rejalashtirish loyihalariga yoki hududlarni kompleks rivojlantirish <\/span><span style=\"font-size: 11pt;\">va<\/span><span style=\"font-size: 11pt;\"> rejalashtirish bo\u2018yicha boshqa hujjatlarga yoxud yer uchastkalaridan foydalanishning ruxsat berilgan turlariga muvofiq amalga oshiriladi, bundan ushbu moddaning ikkinchi qismida nazarda tutilgan hollar mustasno.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"font-size: 11pt;\">Ushbu Qonun kuchga kirguniga qadar vujudga kelgan doimiy foydalanish (egalik qilish), ijara yoxud meros qilib qoldiriladigan umrbod egalik qilish huquqi asosida xususiylashtirish subyektlariga tegishli <\/span><span style=\"font-size: 11pt;\">bo\u2018lgan yer uchastkalari, shuningdek xususiylashtirilishi lozim bo\u2018lgan davlat ko\u2018chmas mulk obyektlari joylashgan yer uchastkalari, mazkur yer uchastkalaridan foydalanishning asosiy maqsadini ushbu moddaning birinchi qismida nazarda tutilgan shaharsozlik hujjatlari tasdiqlanguniga qadar saqlab qolish sharti bilan xususiylashtirilishi mumkin.<\/span><\/p>\n<p style=\"margin-top: 0pt; padding-top: 0; margin-bottom: 8pt; padding-bottom: 0; line-height: 1.3;\"><span style=\"color: #2e74b5; font-size: 11pt;\">12-modda.
